District Court of Appeal, Second District, Division 1, California.

ROHDE v. ROHDE.

Civ. 13551.

Decided: June 06, 1942

Henry E. Phister, of Los Angeles, for appellant. Joseph Henry Wolf, of Los Angeles, for respondent.

The attorneys in the above entitled action having filed in this court their stipulation asking that the judgment in said cause be modified in part, and an examination of the record on appeal showing good cause therefor; the trial court is hereby directed to modify the interlocutory decree entered in said cause by striking therefrom all except the first three paragraphs of said decree, and to amend the last three words of said third paragraph to read “approved and affirmed,” instead of “disapproved and disaffirmed.”

As so modified, the judgment of the trial court is affirmed, the remittitur to issue forthwith, each party to pay his own costs on appeal.

PER CURIAM.
