PEOPLE of the State of California, Plaintiff and Respondent, v. Floyd C. BRITTON et al., Defendants; C. R. Russell, Defendant and Appellant. *
Defendant appeals from a judgment of his conviction for the crime of “kidnaping for the purpose of robbery,” and urges the identical points and presents the same argument thereon that were presented by him to this court in an appeal from another judgment that followed his conviction for a like offense committed under circumstances similar to those which were shown to have existed in the instant case.
For the reasons assigned in the appeal to which reference hereinbefore has been had, to wit, People v. Britton (Cal. App.) 48 P.(2d) 704, it is ordered that the judgment be, and it is, affirmed.
We concur: CONREY, P. J.; EDMONDS, Justice pro tem.
