District Court of Appeal, Third District, California.

STONEBURNER v. THEODORATOS ET AL.

Civ. 4827.

Decided: April 20, 1934

Irving D. Gibson, of Sacramento, for appellants. Ralph H. Lewis and George E. McCutchen, both of Sacramento, for respondent.

The petition of the appellants for a rehearing herein is granted for the sole purpose of reconsidering the question whether the testimony supports the verdict finding George Theodoratos, as the driver of the automobile, guilty of gross negligence at the time of the accident.

It is further ordered that the cause be submitted upon the briefs already on file, with the privilege to the respective parties to file additional briefs, typewritten if preferred, covering the question to be reconsidered, within twenty days from the date of this order.
