City and County of San Francisco v. Sheehan, 13-1412

In a case involving an individual who was arrested after she threatened to kill her social worker and police officers, alleging violations of Title II of the Americans with Disabilities Act of 1990 (ADA) when police arrested her without accommodating her disability, 42 U.S.C. section 12132, the Ninth Circuit's judgment is reversed where the officers are entitled to qualified immunity from liability for the injuries suffered by plaintiff. The question of whether section 12132 "requires law enforcement officers to provide accommodations to an armed, violent, and mentally ill suspect in the course of bringing the suspect into custody," is dismissed as improvidently granted.
