Schwern v. Plunkett, 14-35576

In a case to resolve the lingering uncertainty about the Court's jurisdiction to hear immediate appeals from denials of Oregon anti-SLAPP (strategic lawsuit against public participation) motions, the district court's denial of defendant's anti-SLAPP motion is reversed where plaintiff failed to establish a prima facie case supported by substantial evidence of his claims of defamation, intentional infliction of emotional distress, and intentional interference with economic relations.
