The district court did not err in affirming the Secretary of the Department of Health and Human Services's decision denying plaintiff its full Medicare Annual Payment Update for the fiscal year 2009, where: 1) the Department did not act arbitrarily and capriciously when it refused to excuse plaintiff's late filing of the required data by the admittedly applicable deadline; and 2) plaintiff is not entitled to equitable relief, or the benefit of the contract doctrine of substantial performance, to excuse its failure to submit timely data.
