United States Eighth Circuit

Thomas v. Corwin, 06-1496

In an action alleging disability discrimination under the Americans with Disabilities Act (ADA), age discrimination under the Age Discrimination in Employment Act (ADEA), gender discrimination under Title VII, retaliation, and invasion of privacy, summary judgment for defendant is affirmed where: 1) a requirement that plaintiff undergo a fitness-for-duty evaluation did not violate the ADA; 2) summary judgment for defendants on the age discrimination claim was proper; 3) plaintiff failed to make prima facie cases of gender discrimination and retaliation; 4) the invasion of privacy claim failed; and 5) there was no error in denying a modified motion to amend her complaint.
