Sharma v. USA Int'l, LLC, 15-2188

In a suit arising out of the purchase of two franchise restaurants for a price negotiated and based on a multiple of the gross sales of the restaurants, alleging fraud and conspiracy and seeking as damages the difference between the price plaintiffs paid and the actual value of the restaurants based on a multiple of the restaurants' actual sales, the district court's grant of summary judgment on grounds that that the plaintiffs had not introduced adequate evidence of their damages, particularly of the actual value of the restaurants at the time of the sale, is reversed where the plaintiffs presented sufficient evidence to create a dispute of material fact as to the amount of their damages.
