Priority Auto Group, Inc. v. Ford Motor Co., 13-1696

Dismissal of an action brought by plaintiff, the prospective buyer of a car dealership, against defendant manufacturer-franchisor who exercised its right of first refusal under the franchise agreement, thereby preventing the plaintiff from purchasing the dealership, is affirmed, where: 1) under Virginia law, no cause of action lies when a manufacturer conditions the sale of a franchise on the exercise of its right of first refusal, and thus, the district court did not err in dismissing plaintiff's statutory claim for lack of standing; and 2) the district court did not err in dismissing plaintiff's claims for tortious interference.
