Mullin v. Balicki, 16-2896

Vacating an order denying leave to amend a complaint in the case of a mother's suit relating to her son's prison suicide because her attorney received important evidence that they misfiled and only discovered late in the litigation because, despite the attorney's lack of diligence, this fact alone did not support the denial of leave to amend and some of the factors relied upon in denying leave were not supported by the record or at odds with case law.
