Dancy v. McGinley, 15-140

In a civil rights case brought pursuant to 42 U.S.C. section 1983 involving plaintiffs' injuries during an arrest by police officer defendants, the district court's judgment awarding damages to one plaintiff and denying co-plaintiff's motion for a new trial following a jury verdict in favor of c0-defendant is: 1) affirmed as to judgment in favor of plaintiff Elting and the amount of damages; and 2) vacated as to judgment in favor of officer Williams and remand for a new trial on plaintiff Dancy's excessive force claim.
