United States First Circuit

US v. Fernandez-Hernandez, 09-1285

Conviction and sentencing of defendants on various conspiracy and drug-related charges arising from their involvement with a large illicit drug distribution organization, 21 U.S.C. sections 841(a)(1), 846, 860, is reversed with respect to one co-defendant where although the evidence was sufficient to support his involvement in crimes of drug conspiracy and distribution, it did not support the jury’s findings of elevated quantities of drugs, but affirmed in all respects with the other co-defendants where there are no errors.
