Meuser v. Federal Express Corp., 08-1106
In an adverse employment action, district court's grant of summary judgment for defendant is affirmed where: 1) the court properly dismissed plaintiff's claim under the Massachusetts Civil Rights Act as there is no evidence in the record to show that defendant violated the Act by interfering with plaintiff's rights under the Constitution or laws of the United States or Massachusetts by threats, intimidation or coercion; and 2) the court properly dismissed plaintiff's common law claim for wrongful discharge in violation of public policy as no reasonable jury could conclude that the working conditions reached the level of intolerableness required to provide a basis for a claim of wrongful discharge.
