Collazo v. Nicholson, 06-2678
In a suit brought against defendant-employer alleging discrimination in violation of the Age Discrimination in Employment Act (ADEA), summary judgment for defendants is affirmed where: 1) plaintiff's claim was limited to compensatory damages for pain and suffering; 2) he made no claim for pecuniary benefits related to his job or any equitable relief; and therefore 3) even if he could establish a hostile work environment claim based on the record, the damages he sought were not available under the statute.
