United States First Circuit

US v. Andujar-Arais, 06-1189

Sentence for illegal reentry after deportation is affirmed over claims that: 1) the district court declined to account for "unwarranted" sentence disparities as required by 18 U.S.C. section 3553(a)(6); 2) fast-track sentencing programs violate defendant's constitutional right to equal protection; and 3) the district court erred in treating his prior convictions as sentencing factors.
