Conviction and death sentence for capital murder during a first-degree burglary is affirmed in part and reversed in part where: 1) state courts' rejection of defendant's mental retardation claim was not contrary to, or an unreasonable application of, Atkins v. Virginia, or based on an unreasonable determination of the facts; 2) the district court properly determined the Alabama courts' denial of defendant's claim under Batson v. Kentucky was not an unreasonable application of clearly established federal law or predicated upon unreasonable findings of fact; and 3) the district court erred in granting defendant's habeas writ based on ineffective counsel. Case is remanded with instruction to deny defendant's section 2254 petition.
