Roth v. Green, 05-1129, 05-1272

A sanction award against counsel and a fee award against two individual plaintiffs arising out of a 42 U.S.C. section 1983 action are reversed and vacated, respectively, and remanded where certain letters from defendants were not sufficient to satisfy the requirements of Fed. R. Civ. P. 11(c)(1)(A), and the district court failed to take into consideration the ability of plaintiffs to pay the fee amount.
