Miles v. State of Texas, 1019-06, 1047-06

In a case involving circumstances in which a tow-truck driver made a citizen's arrest of defendant for DWI after pursuing him through busy Houston streets late one night, denial of defendant's motion to suppress evidence obtained as a result of the citizen's arrest is affirmed as there was no abuse of discretion in finding that the citizen had probable cause to arrest defendant for DWI, or in finding that the citizen's traffic violations did not implicate Texas' exclusionary statute.
