Appellate Court of Illinois

Taylor v. Pekin Ins. Co., 5050605

In a complaint for declaratory judgment seeking a declaration of the rights and duties of defendant under the contract of insurance issued by defendant to plaintiff's employer, granting of defendant's motion to dismiss is reversed where plaintiff, who was injured by an uninsured motorist, is entitled to recover the full amount of liability insurance available under his employer's policy, because his employer had purchased uninsured-motorist coverage in that amount and had a reasonable expectation of recovering that amount.
