California Court of Appeal

People v. Delgado, B240880A

Felons whose records include juvenile adjudications that involve serious or violent felonies may not receive county jail commitments under the Realignment Act, and therefore judgment sentencing defendant to state prison for resisting an executive officer (with two prior serious or violent strikes, both of which were juvenile adjudications) is affirmed, but defendant is entitled to 378 days of pre-sentence credit. (Opinion on Rehearing)
