California Court of Appeal

People v. Clark, C064590

Conviction and sentencing of defendant for the misdemeanor assault of his wife and son and felony child abuse are upheld where: 1) legally sufficient evidence support his child abuse conviction; and 2) although the trial court erred by giving a self-defense jury charge only on the assault count and not in connection with the child abuse count, and by failing to instruct on a parental discipline defense with respect to the assault count, such errors were harmless.
