California Court of Appeal

People v. Shafrir, A125880

In a prosecution of defendant for DUI and drug related charges, trial court's grant of defendant's motion under Penal Code section 995 to dismiss the counts alleging violations of Health and Safety Code section 11359 and 11360(a), is reversed as the CHP officers' initial decision to remove the vehicle was reasonable under the Fourth Amendment and the magistrate's denial of defendant's motion to suppress evidence of marijuana and $50,000 found during the inventory search was correct.
